2. Scope of Application

These general terms and conditions of sale govern all sales contracts concluded at a distance through this site. By placing an order, the Customer declares that they have read and accepted the general conditions in force at the time the order is sent.

The conditions may be modified at any time: the contract is always subject to the version published on the site at the time the order was transmitted. We recommend saving or printing the copy received with the order confirmation.

If the Customer is acting within the scope of their entrepreneurial, commercial, or professional activity (purchase with a VAT number and request for an invoice as a taxable person), the consumer protection provisions provided for by Legislative Decree 206/2005 (Consumer Code) do not apply, and in particular, the right of withdrawal provided for in Art. 7 does not apply.

3. Products, Prices, and Availability

Images and product descriptions are for illustrative purposes. Slight differences in shade, grain, or finish compared to the photographs do not constitute a lack of conformity, as they depend on the characteristics of natural materials and the display performance of different screens.

All prices are expressed in Euro and include VAT. Shipping costs, if applicable, are indicated separately and communicated before the completion of the order.

Each new publication of prices cancels and replaces the previous one. The sale is subject to the actual availability of the products.

Should the published price be manifestly incorrect due to a material or IT error (for example, if it is an order of magnitude lower than the market value of the product), the order will not be accepted, and the Customer will be promptly informed and fully refunded for any amount already paid.

4. Conclusion of the Contract

The order transmitted by the Customer constitutes a contractual proposal. The contract is understood to be concluded when Pazzo Design Srls sends the Customer the order confirmation to the email address provided, containing the summary of the purchased products, the total price, shipping details, and information on the right of withdrawal.

The automatic order receipt email, if sent before the confirmation, does not constitute acceptance.

Pazzo Design Srls reserves the right not to accept incomplete or incorrectly filled-out orders, or in the event of product unavailability. In the event of non-acceptance, the Customer will be informed via email and fully refunded for any sum already paid within 14 days.

The invoice or commercial document relating to the order is sent to the Customer via email. Billing data must be entered at the time of the order: once the document has been issued, it cannot be modified. There must be a match between the invoice holder and the holder of the payment instrument used.

5. Payment Methods

The accepted payment methods are indicated on the Payment Methods page, which is an integral part of these conditions.

In the event of unauthorized or unsuccessful payment, the order is automatically canceled.

6. Delivery, Timelines, and Transfer of Risk

Delivery methods, times, and costs are described on the Shipping and Delivery page, which is an integral part of these conditions.

The maximum delivery time is 30 days from the conclusion of the contract, unless a different term is expressly agreed upon and indicated during the order process. Should delivery not take place within this period, the consumer Customer may invite Pazzo Design Srls to effect delivery within an additional period appropriate to the circumstances and, if this period is also not respected, they have the right to terminate the contract and obtain a full refund without delay (Art. 61 of the Consumer Code).

Transfer of Risk. Pursuant to Art. 63 of the Consumer Code, the risk of loss or damage to the goods, for reasons not attributable to the seller, is transferred to the consumer Customer only when they, or a third party designated by them other than the carrier, take material possession of the goods. The risk is transferred already upon delivery to the carrier only if the carrier was chosen by the Customer and such choice was not proposed by Pazzo Design Srls.

7. Right of Withdrawal, Returns, and Refunds

The consumer Customer has the right to withdraw from the contract within 14 days without having to provide any reason. The procedures for exercising this right, the return terms, the allocation of expenses, and refund timelines are described in detail on the Right of Withdrawal, Returns, and Refunds page, which is an integral part of these conditions and serves as information pursuant to Art. 49, paragraph 1, letters h) and i) of the Consumer Code.

8. Legal Guarantee of Conformity

The 24-month legal guarantee of conformity provided for by Arts. 128 et seq. of the Consumer Code applies to the products sold. The conditions and activation methods are described on the Legal Guarantee of Conformity page, which is an integral part of these conditions.

9. Reviews

The reviews published on this site come from customers who have actually purchased the reviewed product; verification takes place by matching the review with the registered order.

10. Complaints and Dispute Resolution

Any complaint can be sent to support@pazzodesign.it or via PEC to pazzodesignsrls@legalmail.it. We undertake to respond within 5 business days and to seek an amicable solution as a priority.

The consumer Customer may also activate a free or low-cost conciliation procedure through the ADR bodies registered in the list kept by the Ministry of Economic Development, including the conciliation desks of the Chambers of Commerce. The activation of such a procedure does not preclude recourse to the judicial authority.

11. Applicable Law and Jurisdiction

The contract is governed by Italian law.

For disputes with consumer Customers, the court of the place of residence or elective domicile of the consumer has exclusive and mandatory jurisdiction (Art. 66-bis of the Consumer Code).

For disputes with Customers who do not qualify as consumers, the Court of Rovigo has exclusive jurisdiction.

12. Privacy

Personal data is processed as indicated in the Privacy Policy, in compliance with Regulation (EU) 2016/679 (GDPR) and Legislative Decree 196/2003 as amended by Legislative Decree 101/2018.
