Right of withdrawal, returns and refunds

In brief

1. Who can withdraw
The right of withdrawal belongs to the Consumer Customer, i.e., the natural person who purchases for purposes unrelated to their business, commercial, craft, or professional activity.
Purchases made with a VAT number and invoice as a VAT-taxable entity are excluded from the right of withdrawal. In these cases, we may evaluate a return as a commercial concession, subject to written agreement.
2. Deadline
The deadline is 14 days starting from:
- the day you or a third party designated by you (other than the carrier) acquires physical possession of the product;
- in the case of an order with multiple products delivered separately, the day you receive the last product;
- in the case of delivery of a product consisting of multiple lots or pieces, the day you receive the last lot or piece.
3. How to exercise withdrawal
It is sufficient to send us an explicit declaration of your decision to withdraw within the 14 days. You can do this:
- via email to support@pazzodesign.it (the method we recommend: it is the fastest and we will provide you with pickup instructions immediately);
- by using the model form provided in point 8, attaching it to the email;
- via PEC to pazzodesignsrls@legalmail.it;
- by registered letter with return receipt to Pazzo Design Srls, Via Polesana per Rovigo 35, 45026 Lendinara (RO).
Please indicate in your communication the order number, the products you intend to return, and the IBAN if the payment was made by bank transfer.
The withdrawal is valid if the communication is sent within the fourteenth day, even if it reaches us later. The burden of proof regarding sending within the deadline lies with you: please keep the shipping receipt.
We will confirm receipt without delay.
4. Product return
After communicating your withdrawal, you have 14 days to return the product or deliver it to the courier.
As these are bulky products that cannot be shipped via ordinary mail, we will organize the collection with the courier and inform you of the cost before proceeding. If you prefer to arrange it yourself with a courier of your choice, you may do so: in that case, the risk of transport is at your expense.
To enable the pickup:
- repack the product in its original packaging. For this reason, we ask you not to throw away the packaging until you have verified that you want to keep the product;
- bring the package to the ground floor, near the road: the courier does not perform pickups from higher floors;
- insert a copy of the order confirmation inside the package.
Product condition. You may handle and inspect the product as you would in a physical store: assembling a chair to try it and then disassembling it does not cause a loss of the right of withdrawal. However, you are responsible for any decrease in value resulting from use that goes beyond what is necessary to establish the nature, characteristics, and functioning of the item (for example: signs of wear, stains, scratches, product used outdoors, assembly resulting in damage to components). In such cases, we will deduct an amount proportional to the decrease in value from the refund, documenting it for you with photographs.

6. Refund
We will refund you within 14 days from the day we receive your notice of withdrawal. As permitted by art. 56, para. 3 of the Consumer Code, we may withhold the refund until we have received the product or until you demonstrate that you have shipped it, whichever occurs first.
The refund includes the price paid and the standard delivery costs, net of the amounts indicated in point 5.
The refund is made via bank transfer, and without additional costs for you. We will ask you for your IBAN: the terms begin from when you provide us with the necessary data.
7. Custom-made products
The right of withdrawal does not apply to products made to measure or clearly customized at your request (art. 59, para. 1, letter c of the Consumer Code).

9. Product arrived damaged or non-conforming
If the product arrives damaged or does not correspond to what was ordered, this is not a withdrawal: it is a lack of conformity and the costs are entirely at our expense. See the Legal Warranty of Conformity page and the checks upon delivery described in Shipping and delivery.
